The current Brazilian Civil Code (Law 10,406 of January 10, 2002) is in force since January 11, 2003, after fulfilling their vacatio legis of a year.
The current Civil Code replaced the first Brazilian Civil Code - Law No. 3,071, dated January 1, 1916 - which entered into force in 1917, after fifteen years of discussion in the Brazilian Congress.
Since the Brazilian Constitution of 1824 envisaged are two codes, the Civil and Criminal, but only the second was achieved. After the independence of Brazil, remained in force the Portuguese legislation, which corresponded to the Filipinas.
There were at least four attempts of drafting the Civil Code:
In 1845, Baron Penedo presented his Da General Revision and Codification of Civil Law and Procedure in Brazil;
In 1864, the unfinished sketch of Augusto Teixeira de Freitas, which was never approved, but served as the basis for the civil codes of Uruguay and Argentina;
In 1881, the Felicio dos Santos project and
In 1890, Coelho Rodrigues project.
Finally, under President Campos Sales and invite your congregation friend of the Law School of Recife, the Minister of Justice Pessoa, Clovis Bevilaqua present, after six months of work, his project of the Civil Code in 1901. Harshly criticized by Rui Barbosa and several jurists of the time as English and Torres de Sousa Neto, work Bevilaqua was strongly influenced by German Civil Code (BGB) and has undergone several changes to its approval in 1916.
After several attempts at drafting new codes such as the Bill of Obligations Code of Orozimbo Nonato, Philadelphus Azevedo and Hannemann Guimarães 1940s, and Caio Mário da Silva Pereira, 1963, a commission headed by Miguel Reale, formed in 1969 during the dictatorship, in 1973 publishes his Draft of the Civil Code, strongly influenced by the Italian Civil Code, a work that is submitted by the Government to the National Congress, where turns in the Draft Law. # 634, 1975. The evolution of the text of the bill in the twenty-seven years and underway in Congress can be found in the work of the Legislative Memory Civil Code. Some decades later under President Fernando Henrique Cardoso, Congress resumes its examination and approval in 2002.
