The current Brazilian Civil Code (Law 10,406 of January 10, 2002) is in force since January 11, 2003, after fulfilling their vacatio legis of a year.

The current Civil Code replaced the first Brazilian Civil Code - Law No. 3,071, dated January 1, 1916 - which entered into force in 1917, after fifteen years of discussion in the Brazilian Congress.

Since the Brazilian Constitution of 1824 envisaged are two codes, the Civil and Criminal, but only the second was achieved. After the independence of Brazil, remained in force the Portuguese legislation, which corresponded to the Filipinas.

There were at least four attempts of drafting the Civil Code:

    In 1845, Baron Penedo presented his Da General Revision and Codification of Civil Law and Procedure in Brazil;
    In 1864, the unfinished sketch of Augusto Teixeira de Freitas, which was never approved, but served as the basis for the civil codes of Uruguay and Argentina;
    In 1881, the Felicio dos Santos project and
    In 1890, Coelho Rodrigues project.
