The Penal Code in force in Brazil was created by decree-law No. 2,848, of December 7, 1940, by then President Getúlio Vargas, with Francisco Campos as Minister of Justice.
Despite being created in 1940, the current Code only came into force on January 1, 1942 (article 361).
The Code originated from a project by Alcântara Machado, submitted to the work of a review committee composed of Nelson Virgínia, Vieira Braga, Narcélio de Queiroz and Roberto Lira. There are historical references to collaborations by Minister Antônio José da Costa e Silva and, in the editorial review, by Abgar Renault, but they were not directly part of the aforementioned commission.
The interpretation of the Penal Code in light of the Federal Constitution reveals the following basic principles: legality, due legal process, culpability, harmfulness, proportionality, individualization, humanization and social value of the sentence, subsidiarity, fragmentarity. Ultimately, Brazilian criminal law is a barrier to defending the individual in the face of the punitive power of the State.
