A. Definition

Salam contract is a form of contract in fiqh muamalah. The greeting referred to here is not a greeting which means peace or greeting. The greeting referred to in this discussion consists of three letters: sin-lam-mim (Óáã ), which means submission and does not mean peace.

It is from this word greeting that the term Islam has its roots, one of which means surrender. While the word greeting which means peace consists of 4 letters, sin-lam-alif-mim (ÓáÇã).

The term greeting (Óáã ) is often also called salaf (ÓáÝ). In most nabawi hadiths, the term that seems to be used more is salaf. But in the book of fiqh, greetings are more often used.

1. Language

In language, greeting (Óáã ) is al-i'tha' (ÇáÅÅÚØÇÁ ) and at-taslif (ÇáÊÓáíÝ). Both mean gift.

The expression aslama ats-tsauba lil al-khayyath means: he has handed over the clothes to the tailor. 1

2. Term

Whereas in sharia terms, the salam contract is often defined by the fuqaha in general as:

Buying and selling of goods whose nature is stated to be dependent with compensation (payment) made at that time.

In simple language, the salam contract is essentially buying and selling with debt. But the difference is, what is owed is not the payment money, but the goods. Meanwhile, the payment is paid in cash.

So this greeting contract is the opposite of credit. If buying and selling on credit, the goods are delivered first and the payment money becomes debt. While the salaf contract, the money is handed over first while the goods have not been handed over and become debt.
