Article 1 About the tsumiki Securities App
1. The tsumiki Securities App (hereinafter referred to as "this app") is a smartphone app that can be used by customers who have opened a securities general account with tsumiki Securities Co., Ltd. (hereinafter referred to as "our company").
2. This app is operated for the purpose of providing various information such as usage status and campaign information to customers who have opened a securities general account with our company.
3. This app can only be used on smartphone devices designated by our company.
4. Downloading this app and using this service is limited to the owner of the smartphone or other device on which the app is downloaded.

Article 2: Agreement to the Terms
To download and use this app, users of this app (hereinafter referred to as "customers") must agree to these terms.

Article 3: Ownership of rights to this app
All rights to this app (including copyright and other intellectual property) belong to our company.

Article 4: Disclaimer
Except in cases of our company's willful misconduct or gross negligence, our company shall not be liable for any damages incurred by customers or third parties as listed below.
(1) Damages incurred in downloading and using this app.
(2) Damages incurred when the customer downloads this app to the smartphone or other device on which the customer downloaded this app, communication equipment, or this app is out of service, or when this app becomes unavailable due to force majeure such as fire, power outage, natural disaster, or war, or damages incurred as a result of such damages.
(3) Damages incurred when the App does not operate normally and becomes unusable due to the condition of the smartphone terminal, etc.

(4) Damages incurred when the Service is used by anyone other than the owner of the smartphone or other device on which the App is downloaded (including cases where the Benefits are not provided).

Article 5 Changes to the App
1. The Company may change or modify the contents of the App as appropriate without prior notice to the customer.
2. Regardless of the above, if changes are made that have a significant impact on the customer, they will be announced or notified in advance.
3. If the Company changes or modifies the App after the customer downloads the App, the customer will need to download the latest version of the App again before using the Service.

Article 6 Notes on downloading and using the App
1. Communication fees may be charged when downloading the App (including re-downloading) and using the Service, and in this case, all communication fees shall be borne by the customer.
2. Information entered by the customer in the App may be lost before the Company receives it due to the operation of the App, and the Company shall not be held liable in any way.
3. To use this app, you will need to authenticate yourself using the Epos Net ID and password specified by our company.

4. By changing the login method, this app allows you to authenticate yourself without entering your ID and password. In that case, if the smartphone on which this app is downloaded is handed over to a third party, your personal information and trading information may be viewed by the third party. Please keep your smartphone and password safe when using this app. If the app is not used for a specified period of time, you may be logged out without notice.

5. This app provides links to various services on the "tsumiki Securities website". Each link may take you to a web page on the "tsumiki Securities website" using Webview or a browser.

6. When you use this app, we record the operation information in the form of an access log. Our company uses the access log for analysis and statistics to improve the service of the app. The access log does not contain any information that can identify a specific individual.

Article 7 Prohibited Matters
Our company prohibits the following actions regarding your use of this app.

(1) Using the information posted on this app for purposes other than the use of this app.

(2) Using the App for purposes other than those approved by our company, such as commercial activities, religious activities, or political activities.
(3) Sending or posting content that includes harmful computer programs to the App.
(4) Installing and using only a portion of the App.
(5) Modifying the App. Or reverse engineering (mainly referring to analyzing the contents of software and converting it into a form that can be read by humans), decompiling, disassembling, or other similar acts.
(6) Copying or adapting all or a portion of the App.
(7) Publicly transmitting, distributing, transferring, lending, or otherwise using all or a portion of the App, whether for a fee or free of charge.
(8) Any act that infringes or may infringe the rights of our company or a third party.
(9) Any act that slanders or libels or damages the reputation of our company or a third party, or any act that may infringe the rights of our company or a third party.

(11) Selling, renting, or licensing the App or its usage rights to a third party.

(12) Any act that may interfere with the operation of the Service or otherwise impede the provision of the App.

(13) Any act that violates these Terms and Conditions, etc., or any act that the Company deems inappropriate.

(14) Any other act that violates or may violate laws, regulations, public order, or good morals.

Article 8 Suspension or Termination of the Service
The Company may suspend or terminate the download of the App and the Service without prior notice to the customer.

Article 9 Mutandis Application of Terms
In the use of the App, other terms and conditions, such as the "Tsumiki Securities Terms and Conditions" and the "Agreement for Information Transfer", shall apply mutatis mutandis to matters not specified in these Terms and Conditions.

Article 10 Changes to Terms
The Company may change the contents of these Terms and Conditions. The Terms and Conditions in effect at the time of use of the Service shall apply, including any changes made after the App is downloaded.
