Basic Law of Selling Waqf Assets
Basically, the substance of waqf is to spend wealth in the way of Allah, by retaining the property or perpetuating the principal, and channeling the benefits continuously.
As the instructions of the Prophet SAW to Umar bin Khattab when Umar got a date palm plantation as a ghanimah after the Khaibar war.
"From Ibn Umar ra said that Umar bin al-Khattâb got a piece of land in khaibar. He came to Rasulullah SAW asking for his opinion, "O Messenger of Allah, I got a piece of land in Khaibar where I have never got more valuable property than that before. Then what do you order me in this matter of wealth?". So Rasulullah SAW said, "If you want, you can keep the principal and you give alms with the harvest. But with the condition that you don't sell the principal (the land), don't give it away, don't inherit it". So Umar ra gave alms with the proceeds to the fuqara, dzawil qurba, the slaves, ibn sabil as well as the guests. There is nothing wrong if the person who takes care of it eats the produce or gives it to his friends in a good way, but it is not permissible to do business.”
In this hadith, the Prophet explicitly stipulates conditions, prohibiting changing waqf property that has been donated, selling it, inheriting it or even just donating it.
