Gono-Gini Between Adat and Shari'a
Gono-gini is a term known by most Javanese culture and its surroundings to refer to assets that are jointly owned by husband and wife in marriage.
So, the assets produced by one of the spouses; whether the wife or the husband, during their marriage, the property is common property. This is what is meant by gono-gini assets or also commonly referred to as joint assets.
Therefore, if there is a separation between the two, be it a life separation, or also a death separation, the existing assets must be divided in half first; because the property is jointly owned. So when it is no longer said to be together, ownership of assets returns to each individual.
For example, if a husband divorces his wife, then the husband may not take possessions that he considers to be his own because they are due to his own efforts. He had to divide it 50 to 50 to give the ration to his wife.
Likewise if one partner dies. The assets left behind cannot be directly used as inheritance which is then given to the heirs. The property must be given half, namely 50% to the spouse who lives as joint property. And the rest, then used as inheritance which is distributed to the existing heirs.
