■tsumiki Securities App Terms of Use

Article 1: About the tsumiki Securities App
1. The tsumiki Securities App (hereinafter referred to as the "App") is a smartphone app available to customers who have opened a comprehensive securities account with tsumiki Securities Co., Ltd. (hereinafter referred to as the "Company").
2. This App is operated for the purpose of providing various information, such as usage status and campaign information, to customers who have opened a comprehensive securities account with our Company.
3. This app can only be used on smartphone devices designated by our company.
4. Downloading this app and use of this service are limited to the owner of the smartphone or other device on which the app is downloaded.

Article 2: Agreement to the Terms
To download and use this app, users of this app (hereinafter referred to as "Customers") must agree to these Terms.

Article 3: Ownership of the App
All rights to this app (including copyright and other intellectual property) belong to our company.

Article 4: Disclaimer
Our company shall not be liable for any of the following damages incurred by customers or third parties, except in cases caused by our willful misconduct or gross negligence:

(1) Damages incurred during the downloading and use of this app.

(2) Damages incurred when the app becomes unusable due to malfunctions of the smartphone or other device on which the customer downloaded the app, communication equipment, or the app, line outages, or force majeure such as fire, power outages, natural disasters, or war.
(3) Damages arising from the malfunction or unavailability of the App due to the condition of the smartphone device, etc.
(4) Damages arising from the use of the Service by anyone other than the owner of the smartphone or other device on which the App is downloaded (including the failure to provide Benefits).

Article 5: Changes to the App
1. We may change or modify the content of the App as appropriate without prior notice to you.
2. Notwithstanding the above, if we make changes that have a material impact on you, we will announce or notify you in advance.
3. If we change or modify the App after you download it, you will need to re-download the latest version of the App before using the Service.

Article 6: Notes on Downloading and Using the App
1. Downloading the App (including re-downloading) and using the Service may incur communication charges. In such cases, all communication charges are the sole responsibility of the customer.
2. Information you are entering into the App may be lost before it is received by us due to the operation of the App. We shall not be liable for any such loss.
3. To use this app, you will need to authenticate yourself using your Epos Net ID and password.

4. By changing the login method for this app, you can authenticate yourself without entering your ID and password. In this case, if the smartphone on which you downloaded this app is transferred to a third party, your personal information and trading information may be accessed by that third party. Please keep your smartphone and password safe when using this app. Please note that if you do not use the app for a specified period of time, you may be logged out without notice.

5. This app provides links to various services on the "tsumiki Securities website." Each link may take you to a web page on the "tsumiki Securities website" via Webview or a browser.

6. As you use this app, we record your operation information in the form of an access log. We use this access log for analysis and statistics to improve our app services. The access log does not contain any information that can identify specific individuals.

Article 7: Prohibited Conduct
We prohibit the following actions regarding your use of this app.

(1) Using information posted on this app for purposes other than using this app.
(2) Using the App for purposes other than those approved by our company, such as commercial, religious, or political activities.
(3) Sending or posting content that includes harmful computer programs to the App.
(4) Installing or using only a portion of the App.
(5) Modifying the App, or reverse engineering (primarily referring to analyzing the contents of software and converting it into a human-readable form), decompiling, disassembling, or other similar acts.
(6) Reproducing or adapting all or part of the App.
(7) Publicly transmitting, distributing, transferring, lending, or otherwise using all or part of the App, whether for a fee or free of charge.
(8) Any act that infringes or is likely to infringe the rights of our company or a third party.
(9) Any act that slanders or defames our company or a third party, or any act that is likely to infringe the rights of our company or a third party.
(10) Providing false information to the App.
(11) Selling, renting, or licensing the App or its usage rights to a third party.
(12) Any act that interferes with the operation of the Service or otherwise may impair the provision of the App.
(13) Any act that violates these Terms and Conditions, etc., or any act that uses the App in a manner that the Company deems inappropriate.
(14) Any other act that violates or may violate laws, regulations, or public order and morals.

Article 8: Suspension or Termination of the Service
The Company may suspend or terminate the download of the App and the Service without prior notice to you.

Article 9: Application of Terms Mutatis Mutandis
With regard to matters not specified in these Terms and Conditions, other terms and regulations, such as the "tsumiki Securities Terms and Conditions" and the "Agreement on Information Exchange," shall apply mutatis mutandis to the use of the App.

Article 10: Changes to the Terms and Conditions
The Company may change the contents of these Terms and Conditions. The Terms and Conditions in effect at the time of use of the Service shall apply, including any changes made after the App is downloaded.
