A. Fatwa, Ijtihad and Qadha'

1. Definition of Fatwa

The term fatwa is a term that is already popular in the study of ushul fiqh and fiqh, fatwa comes from Arabic from the root word "fata" which means youth. by memorizing the letters "waw" or pronouncing the letters "waw" read "fatawi" is the noun form of the sentence "fata-yaftu-fatawa" which means "someone who is generous and generous". The person who gives the fatwa is called a mufti. When it comes to the definition of lughawi above with muftis, the tendency is very close, because a mufti is always generous in imparting his knowledge to anyone who asks for a fatwa.

According to al-Fyumi, fatwa comes from the word "al-fata" which means "Strong youth". This meaning gives the understanding that a mufti must be strong in giving arguments from those who ask for a fatwa.

In the book "al-Mu'jam al-Wasith" it is stated that fatwa is defined as "An answer to something that is abstruse in matters of Islamic law and legislation."3

In the book “Lisana al-'Arab”, fatwa is explained in a light way by the term “al-futya-wal futwa'” which is defined as “ifta'” which is the masdar term for “ifta', yafti-ifta'” which means “to give explanation” or “something that a faqih instructs or it can be said that I give him a statement regarding his problem when I answer the problem.”
