(1) What is the criterion for recognizing the percentage of negligence?
- It is the only official standard in Korea which is made with reference to court cases, laws, dispute settlement cases, etc.
- The accrual rate standard is based on Attachment 15 (Attachment 3 of the automobile insurance standard) of the Supervisory Regulation for Insurance Business Supervision, which is administered by the Financial Supervisory Service.
- Approximately 80% of all accidents are one-sided flaws (100: 0), but they are accepted without any disagreement. About 20% of the cases are due to mutual disputes. At this time, the accreditation standard is used, which contributes to prompt compensation process, standardized calculation of the accrual rate, ease of predicting the accrual rate, and the stability of the automobile insurance system and the exemption standard.
