Meaning of 'Ariyah

'Ariyah comes from the word i'arah which means to lend.

In terms of the science of fiqh, the scholars define 'ariyah with two different definitions. Hanafiyyah1 and malikiyyah scholars define 'ariyah as follows:

"Giving up beneficial ownership (of an object) within a certain time without compensation."

Meanwhile, the Shafi'iyyah, Hanbilah and Zahiriyyah scholars define 'ariyah as follows:

"Permission to use lawful goods is used, where the goods remain in their form without being accompanied by compensation."

Each of the two definitions above produces different legal consequences. Hanfiyyah and Malikiyyah consider that 'ariyah is the surrender of ownership of the usufructuary of an object within a certain period of time. That means, the borrower of the goods during the loan period has the right to lend or rent the borrowed goods to other parties without the permission of the owner of the goods. because he is considered to have the right to use the item.
