● Brief Introduction to the 2019 New Drunk Driving Law
The new regulations focus on separating cars and motorcycles and increasing fines for drunk driving violations. The fine for a first-time drunk driving offense on a motorcycle remains unchanged at NT$15,000 to NT$90,000, but for a car, the fine has increased from NT$15,000 to NT$90,000 to NT$30,000 to NT$120,000. A second drunk driving offense within 5 years will be subject to the maximum fine: NT$90,000 for motorcycles and NT$120,000 for cars. A third or subsequent offense will incur an additional NT$90,000 fine per offense. Refusal to take a breathalyzer test or undergo a breathalyzer test will also be punished more severely, increasing from NT$90,000 to NT$180,000, with each subsequent offense within 5 years incurring an additional NT$180,000 fine.
In addition to fines, a first-time motorcycle offender will have their license suspended for 1 year, and a car offender for 2 years. If the offender is carrying a child under 12 years old or causes an accident resulting in injury, their license will be suspended for 2 to 4 years. For drunk driving accidents resulting in serious injury or death, the vehicle may be confiscated.
In addition, new penalties have been added for passengers sharing responsibility for drunk driving. Passengers aged 18 and above can be fined between NT$600 and NT$3,000, excluding those who are too old, mentally disabled, or passengers on taxis, buses, or other public transportation.
