精神醫學與法律交會之際係源起於歐美各國之司法改革，其所主張之精神障礙犯罪不應受罰，遂有司法精神鑑定興起。本書針對刑事責任能力鑑定、民事鑑定之監護與輔助宣告及各類損害賠償之失能鑑定、精神鑑定之臨床現況、鑑定原則及工具等，透過比較法的角度多所論述。亦關注精神疾病者之人權保障、緊急安置、強制治療等制度與運作。臺灣自精神衛生法施行以來，對於病人治療權及人權提供更完善之機構規範及責任。近年來眾所注目的有、無「教化可能性」成為論罪的重點，亦從實務角度加以討論。
