近年各校法律系相關科系均開設醫事法規相關課程，醫事法規除探討醫療關係外，藥事法的部分也是很重要的一部分，但是藥事責任卻缺乏相關的論著，極少有論著探討藥物不良反應時，藥商應該負甚麼責任?然而此問題，不僅消費者關心，藥商也會非常關注在何種情況下其應負責，負何種責任。
關於此問題，不僅我國有相關案例，在美國、德國及日本亦有相當多的探討。在我國關於藥事責任的規定係適用民法、消費者保護法等規範，在藥事法中除部分行政責任外，並沒有直接關於民事責任之規範。其他國家如德國在藥事法有清楚規範，美國在侵權行為法彙編中有特別規定，日本有製造物責任法的規定，相較其他國家規範，我國尚有許多修正的空間。本書除對各國法制探討外，也會輔以相關的案例，加以探討，探討在此等案例中藥商應該負何種法律責任。此書不僅可以提供做為學校教學及實務的參考，亦可做為將來立法之參考。
