About this ebook
於2012年間，我國發生數起因都市更新而生之社會衝突，突顯出現行都市更新條例問題點。都市更新條例無法有效與都市計畫連接、且程序面上過於簡略，難使更新單元內權利人受到完整的保障。又都市更新條例對於更新團體內之溝通、協調及整合意見相關規定並未完足，將使得都市更新團體內產生資訊不對等、強弱勢實力過大，更新團體內利益分配失衡問題。都市更新條例實已有窒礙難行之情形。
本文在上述背景下，從都市問題之起源及類型開展討論，描繪都市更新條例運行下所產生之角色圖譜及風險利益分配，並進一步思考都市更新條例之憲法問題。本文也透過比較法之方式，解析都市更新制度之共同特徵。最後本文希望能突破現行架構，以實施者改革為中心進行另類思考，並提出組織型公私夥伴關係適用於都市更新法制之可能性，希望能夠拋磚引玉為我國都市更新制度帶來不同的討論面向。
