本書以民主、稅賦、比例性這三個範疇作為行政法學的內容係基於──行政權來源於民主、以稅賦為基礎、受比例性約束──之認知。 在民主與行政權的關係中，基本權利是約束行政權運行的最高根據。基於權力分立原則產生、存在和運行的司法權即是為了保障基本權利而制約立法權和行政權。在稅賦方面，則是牽涉到管理與給付的概念，因為無論是管理行政還是給付行政，行政機關都需要以稅賦為基礎；沒有稅收，行政機關就無法進行管理與給付。因此，稅賦與行政權的關係既體現了基本權利對行政權的制度意義，也體現了行政權對基本權利的制度意義。最後，從比例性概念延伸出來的觀點是，保障基本權利的原則即為比例原則，透過比例原則要求行政機關在達成管理與給付的目的時不得過度侵犯相對方的基本權利。
