書主要分析德國行政法自1990年代初期以來，對其研究方法、管制理論及立法學上之反省檢討理論，此種行政法之研究取徑，被德國學者稱為「德國新行政法學」，德國新行政法學研究方法及重心之位移，同時也影響到德國行政法總論及各論之內容與體系，最後也影響到德國行政法之立法。 我國行政法總論及各論（含警察法、社會法、公務員法、國土計畫法、環境法、經濟法等）體系及內容深受德國法影響，形成行政組織法、行政作用法及行政救濟法三大主要體系，但卻未能深刻全面認識到德國行政法之新發展趨勢，本書乃作為「中間性報導」德國新行政法學的國內第一本專書，因為德國新行政法之改變，仍在不斷演變中，但仍可以給我國學術界及實務界帶來部分啟發。
