本書是作者多年以來思考建構政治憲法學理論的成果。全書共十六章，分為「思想紛爭」、「基本觀念」、「制度因緣」和「道路統緒」四篇。作者從確立其政治憲法學的理論觀點開始，繼而闡釋憲法權威、公民資格、自由政治與國家構建等基本憲法觀念，進而分析及比較中西憲法制度，突出政治憲法學不同於規範憲法學與憲法釋義學的問題意識和理論視野，終而從歷史的角度為未來的中國憲制乃至世界憲制，提供理論規劃。
作者認為，現代中國處於一個由非常政治到日常政治的憲制轉變時期。在這個時期，憲法起着終結革命、建構制度的作用，並可透過憲法完成建國進程，從非常政治轉變為日常政治，迎來司法憲政主義的時代。政治憲法學正是以歷史的視野，發現政治憲法結構中從現實主義到規範主義、從黨制國家到憲政國家、從人民主權到個人自由的歷史趨勢。
