ตำแหน่งนายกรัฐมนตรีนั้นมีขึ้นภายหลังการเปลี่ยนแปลงการปกครองเมื่อปี พ.ศ. 2475 เรียกว่า "ประธานคณะกรรมการราษฎร" ตามพระราชบัญญัติธรรมนูญการปกครองแผ่นดินสยามชั่วคราว พุทธศักราช 2475 และภายหลังพระบาทสมเด็จพระปรมินทรมหาประชาธิปกลงพระปรมาภิไธยในรัฐธรรมนูญแห่งราชอาณาจักรสยาม พุทธศักราช 2475 เมื่อวันที่ 10 ธันวาคม พ.ศ. 2475 ก็เปลี่ยนมาเรียก "นายกรัฐมนตรี"
นายกรัฐมนตรี คือ ตำแหน่งหัวหน้ารัฐบาลของประเทศไทย โดยรัฐธรรมนูญแห่งราชอาณาจักรไทยที่มีใช้อยู่ในขณะนั้นได้บัญญัติเอาไว้ว่า ให้พระมหากษัตริย์ทรงแต่งตั้งตามคำแนะนำของประธานรัฐสภา จากผู้เป็น ส.ส.หรือสมาชิกสภาผู้แทนราษฎรหรือไม่ก็ได้
