自2005年以來，作者基於對法學方法論的興趣，致力於將法學方法論的研究成果，運用在具體憲法問題的分析上，希望藉此為公法學之研究，開拓更寬廣的視野。本書所含括的三個部分，也分別凸顯作者近年來在法學方法論領域最關心的三個相關連主題：第一部分「處於規範與現實交界的司法權」，除了探討德國法學方法論傳統從自由法運動以降的發展軌跡，呈現司法權必須兼顧法體系拘束及個案正義的特色之外，也藉此對我國釋憲實務上的若干爭議提出檢討；第二部分「科際整合趨勢下的法學方法」，表達對當代法學科際整合之呼籲的觀察與反省；第三部分「法比較與法繼受」，則涉及憲法學在制度比較或繼受的過程當中所牽動的方法論難題。
