About this eBook
教唆，係指以使他人犯罪為目的，對於本無犯罪意思之人，以挑唆或勸誘等方式，使其萌生犯罪決意進而實行犯罪之行為。由於教唆者本身未直接實行犯罪，法理與實務上應如何處罰教唆犯常生爭議，尤其當被教唆人未完全依循教唆者之教唆內容，如未實行犯罪或實行犯罪但逾越教唆範圍時，判斷更顯困難。另外，陷害教唆，特別是國家偵察機關作為教唆主體時，非法之陷害教唆與合法之誘捕偵查界限如何劃分，係同時涉及刑事實體法與刑事訴訟法之重要議題，值得密切注意。
