머 리 말 이 책은 공익사업을 위한 토지 등의 취득 및 보상에 관한 법률 제20조에 의하여 국토교통부장관의 사업인정을 받아 공익사업의 시행자에게 수용권을 설정하는 과정에서 이해관계 당사자들이 행정구제를 도모하고자 할 때에 도움을 주기 위한 책이다. 사업인정이란 공익사업을 토지 등을 수용 또는 사용할 사업으로 결정하는 것으로서 공익사업의 시행자에게 그 후 일정한 절차를 거칠 것을 조건으로 일정한 내용의 수용권을 설정하여 주는 형성행위이다. 공익사업을 위한 토지 등의 취득 및 보상에 관한 법률은 공익사업에 필요한 토지 등을 협의 또는 수용에 의하여 취득하거나 사용함에 따른 손실의 보상에 관한 사항을 규정함으로써 공익사업의 효율적인 수행을 통하여 공공복리의 증진과 재산권의 적정한 보호를 도모하는 것을 목적으로 한다. 이러한 토지보상 과정에서 위법하고 부당하게 권리를 침해당하였다면 정당하게 행정구제를 받아야 할 것이다. 그러한 행정구제 과정에서 억울한 당사자들에게 조금이나마 도움이 되기를 기원한다. 2022. 12. 13. 천진우
